1. Description of Service

DataStreak ("we," "us," or "the Service") is a sports analytics and research platform operated by Dantes Sports Data. We provide data-driven tools, statistical models, and informational content designed to help users research sports betting markets.
We are not a sportsbook. We do not accept, place, or process bets of any kind. We do not handle wagering funds. DataStreak is an informational and entertainment product only.

2. Eligibility, Age & Legal Responsibility

You must be 21 years of age or older (or the legal age for sports wagering content in your jurisdiction, whichever is higher) to use DataStreak. By creating an account, you confirm that you meet this age requirement.
You are solely responsible for knowing and complying with all federal, state, and local laws regarding sports betting in your jurisdiction. Sports betting is not legal in all U.S. states or countries. By using DataStreak, you acknowledge that:
•
It is your responsibility - not ours - to determine whether sports betting is legal where you live.
•
You will not use DataStreak to facilitate illegal gambling activity.
•
DataStreak does not provide legal advice regarding the legality of sports betting in any jurisdiction.
•
If sports betting becomes illegal in your jurisdiction, you must discontinue use of the Service for wagering-related purposes.

3. User Obligations, Accounts & Account Sharing

By using DataStreak, you agree to:
•
Provide accurate information when creating your account.
•
Not share, resell, or redistribute DataStreak content, data, or tools.
•
Not scrape, crawl, or programmatically access the Service without written permission.
•
Not use the Service for any unlawful purpose.
•
Not interfere with the operation of the Service or its infrastructure.
Accounts are personal. Each account is for one person's individual use. You may not share your login credentials, allow others to access the Service through your account, or pool a single subscription across multiple people. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us promptly at support@datastreak.com if you believe your account has been compromised.
We reserve the right to suspend or terminate accounts that violate these terms, including shared accounts.

4. Subscriptions, Billing, Auto-Renewal & Refunds

DataStreak offers paid subscription plans billed on a recurring basis through Stripe, our payment processor: the standard plan bills every 4 weeks (28 days), and the annual plan bills once a year. We do not store your full credit card details. By starting a subscription you agree that:
•
Subscriptions automatically renew. Your card on file will be charged at the start of each billing period (every 4 weeks, or once a year on the annual plan) at the then-current rate for your plan until you cancel.
•
New subscriptions include a 7-day trial for $1. The $1 activation fee is charged today and is non-refundable; you will not be charged the recurring subscription price if you cancel before the trial ends.
•
Cancellation is available anytime in Settings, Billing, or by emailing support@datastreak.com. Cancellation takes effect at the end of your current billing period; you retain access through that end date.
•
Annual-plan renewal reminders - for annual subscriptions we will send an email notice 15-30 days before each automatic renewal, summarising the renewal date, amount, and cancellation steps (California Automatic Renewal Law / similar state requirements).
•
Price changes on existing subscriptions take effect at the next renewal and are communicated by email at least 30 days in advance.
•
Refunds are governed by our Refund Policy.
Subscriptions purchased through a mobile app store (Apple App Store or Google Play) are billed and managed by that store; see Section 12.

5. Prediction-Market & Exchange Content

Some DataStreak tools (including the prediction-markets comparison tools and Exchange Duel) display prices from event-contract exchanges such as Kalshi and Polymarket. These markets are event contracts - in the United States, Kalshi operates as a CFTC-regulated designated contract market - and they are not sports betting or sportsbook wagering.
DataStreak is not a broker, futures commission merchant, exchange, or intermediary for any event contract or prediction market. We display exchange prices for research and comparison only; we do not execute, route, or custody trades. If you choose to trade on any exchange, you do so on that platform, under its terms, and subject to its eligibility rules. Exchange prices shown on DataStreak may differ from live prices on the exchange.

6. Your Content (Bet Journal, Slips & Results)

Some features let you create content on the Service - for example bet slips, journal entries, and tracked results ("Your Content"). You own Your Content. By creating or sharing it through the Service you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and process it as needed to operate the features you use - including displaying a slip publicly when you choose to generate a shareable link or image.
You are responsible for Your Content. We may remove content that violates these Terms or the law. Deleting your account or a slip removes it from public display, though residual copies may persist in backups for a limited period.

7. Intellectual Property

All content, algorithms, designs, and branding on DataStreak are the property of Dantes Sports Data. You may not copy, reproduce, or distribute any part of the Service without prior written consent.

8. Phone Number & SMS Communications

If you provide a phone number during signup or in your account settings, you agree that DataStreak may collect, store, and use that number to send you communications by SMS / MMS at any time.
These communications may include, but are not limited to:
•
Transactional messages (account notices, billing alerts, password recovery, security events).
•
Service notifications related to features you use (streak alerts, line-movement alerts, lineup updates, etc.).
•
Marketing and promotional messages, including new feature announcements, partner offers, content recommendations, and discounts.
By providing your phone number, you give your express consent to be contacted at that number by automated means. Message frequency varies. Message and data rates may apply. You may opt out of marketing SMS at any time by replying STOP to any message; opting out of marketing communications does not affect transactional messages required to operate your account.
You represent that the phone number you provide is yours, or that you have the account holder's permission to provide it. You agree to keep your phone number current and to update it in your account settings if it changes.

9. Referral & Partner Program

DataStreak operates a referral/partner program that pays commissions for qualifying referred subscriptions. If you participate:
•
Eligibility - you must have an approved partner account, be at least 21, and provide accurate payout and tax information (including a W-9 or equivalent where required) before payouts are made.
•
Payouts - commissions accrue on qualifying referred payments as described in the partner portal and are paid on the schedule shown there. Amounts, tiers, and qualification rules may change prospectively.
•
Fraud & clawback - self-referrals, incentivized or deceptive signups, spam, bidding on our brand terms, and referred payments that are refunded, disputed, or charged back do not qualify. We may withhold or claw back commissions attributable to fraud, abuse, or refunded payments.
•
Advertising honestly - you may not make earnings claims, guarantee betting outcomes, or misrepresent the Service in promoting your referral link, and you must disclose your material connection to DataStreak where required (FTC endorsement guides).
•
Termination - we may suspend or terminate program participation for violations of these rules; accrued, non-fraudulent commissions earned before termination will be paid per the normal schedule.

10. Early Access & Beta Features

We may label some features as early access, beta, preview, or experimental. Those features are provided as-is, may be modified or withdrawn at any time without notice, may produce incomplete or inaccurate output, and are excluded from any commitments elsewhere in these Terms to the maximum extent permitted by law.

11. Affiliate & Sportsbook Relationships (FTC Disclosure)

Some pages on DataStreak include links to third-party sportsbooks, exchanges, courses, or services. We may receive a referral fee, commission, or other compensation when you click those links or sign up through them. This does not affect what you pay or how we rate products. Where required, those links are marked or disclosed alongside the content. By using DataStreak you acknowledge this commercial relationship.

12. Mobile Apps & App Store Terms

If you access DataStreak through an app distributed via the Apple App Store or Google Play, the following also apply:
•
These Terms are between you and Dantes Sports Data only - not with Apple Inc. or Google LLC. Apple and Google are not responsible for the Service or its content and have no obligation to furnish maintenance or support for it.
•
Subscriptions purchased in-app are billed by the app store under its terms; refund requests for those purchases are handled by the store (for Apple, via Apple's refund process), not by our Refund Policy.
•
In the event of any failure of an app to conform to an applicable warranty, you may notify Apple and Apple will refund the purchase price of the app; to the maximum extent permitted by law, Apple has no other warranty obligation.
•
Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to your use of the iOS app, and may enforce them against you as such.
•
You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government list of prohibited or restricted parties.

13. Disclaimers & Limitation of Liability

DataStreak provides tools and data for informational purposes only. We make no guarantees regarding the accuracy, completeness, or timeliness of any data or analysis; the outcome of any sporting event or wager; or profits, returns, or financial results of any kind. Past performance does not guarantee future results. Sports outcomes are inherently unpredictable. You assume all risk associated with any decisions you make based on information from our Service.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. DataStreak does not warrant that the Service will be uninterrupted or error-free, or that the analytics provided will result in winning bets.
To the maximum extent permitted by law, DataStreak's total liability for any claim arising out of these Terms or the Service shall not exceed the amount you paid us in the twelve months preceding the claim. In no event shall Dantes Sports Data be liable for indirect, incidental, consequential, special, or punitive damages, or for lost profits or lost data, even if advised of the possibility of such damages. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Dantes Sports Data and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use or misuse of the Service; (b) Your Content; (c) your violation of these Terms; (d) your violation of any law or the rights of a third party, including any wagering you choose to place. We reserve the right to assume the exclusive defense of any matter subject to indemnification by you, in which case you agree to cooperate with our defense.

15. Dispute Resolution & Arbitration

PLEASE READ THIS SECTION CAREFULLY - IT AFFECTS YOUR LEGAL RIGHTS.
Informal resolution first. Before starting an arbitration or a small-claims case, you and DataStreak agree to try to resolve the dispute informally: the party raising the dispute sends the other a written notice (for us: support@datastreak.com with the subject "Dispute notice"; for you: the email on your account) describing the dispute and the relief sought, and both parties negotiate in good faith for 30 days. Arbitration may only be started after that period ends. This step often resolves disputes faster and cheaper than any formal process.
Binding individual arbitration. You and DataStreak agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service - whether in contract, tort, statute, or otherwise, and including disputes about the scope or enforceability of this arbitration agreement - shall be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. This agreement is governed by the Federal Arbitration Act. The arbitration will be conducted by videoconference or telephone, or, if either party requests an in-person hearing, in the county where you live. Arbitration fees are allocated as the AAA Consumer Arbitration Rules provide; if the arbitrator finds a claim frivolous, fees may be reallocated as those rules permit. The arbitrator's award may be entered in any court with jurisdiction.
Class action waiver. You and DataStreak agree to bring any dispute only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, representative, or consolidated proceeding. The arbitrator may not consolidate more than one party's claims. If this class action waiver is found unenforceable or unlawful as to a particular dispute, then the entire arbitration agreement (but not this Section's other provisions) shall be void as to that dispute - class or representative proceedings may only be heard by a court, never an arbitrator.
Carve-outs. Either party may (a) bring an individual claim in small-claims court if it qualifies and remains in that court on an individual basis, and (b) seek injunctive or other equitable relief in court to protect its intellectual property or prevent unauthorized access to the Service, without waiving arbitration for other claims.
Coordinated filings. If 25 or more similar arbitration demands are filed against DataStreak with the assistance of the same or coordinated counsel, the parties agree the demands will be resolved in staged batches under the AAA's mass-arbitration procedures (or, absent applicable AAA procedures, in batches of up to 25 with a single arbitrator per batch), with filing fees due only as each batch proceeds.
Opt-out. You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@datastreak.com with the subject "Arbitration opt-out" and your account email. Opting out does not affect any other provision of these Terms.
Governing law and survival. These Terms are governed by the laws of the State of Ohio, without regard to its conflict-of-laws principles, except that the Federal Arbitration Act governs this arbitration agreement. Subject to the arbitration agreement above, any disputes must be brought in the state or federal courts located in Stark County, Ohio. This Section survives termination of your account or these Terms.

16. Accessibility

We strive to make DataStreak accessible to all users, including those with disabilities, and target conformance with the Web Content Accessibility Guidelines (WCAG) 2.1 Level AA. We continue to improve accessibility on an ongoing basis. If you have trouble using any part of the Service, please contact support@datastreak.com with the subject line "Accessibility" and a description of the issue, and we will work with you to provide the information, item, or transaction you seek through an accessible method.

17. DMCA & Copyright Complaints

DataStreak respects intellectual property rights. If you believe content on our service infringes your copyright, send a DMCA notice including (a) a description of the copyrighted work, (b) the URL or location of the allegedly infringing material, (c) your contact information, (d) a statement that you have a good-faith belief that the use is not authorized, and (e) a statement, under penalty of perjury, that the information is accurate and that you are authorized to act on the copyright owner's behalf.
Send DMCA notices to: support@datastreak.com with subject "DMCA Notice", or by mail to the address below. We respond to valid notices by removing the content and notifying the uploading user.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or an in-app notice. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.

19. Miscellaneous

•
Entire agreement - these Terms, the Privacy Policy, the Refund Policy, and the Disclaimer are the entire agreement between you and Dantes Sports Data regarding the Service, and supersede any prior agreements on the subject.
•
Severability - if any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions - including the arbitration agreement - remain in full force.

Force majeure - we are not liable for any delay or failure to perform caused by events beyond our reasonable control, including outages of third-party data providers, internet or hosting failures, labor disputes, governmental action, or acts of God.

•
No third-party beneficiaries - except as stated in Section 12 (Apple), these Terms create no third-party beneficiary rights.
Privacy - our collection and use of personal information, including the rights of EU/UK residents under GDPR, is described in the Privacy Policy.
